Submitted by: Joseph Camillo, Esq., Shechtman Halperin Savage, LLP | As you may be aware, on August 11, 2015 in Paiva v. The Bank of New York Mellon, the United States District Court for the District of Massachusetts declared a foreclosure void for two reasons: (1) failure to strictly comply with Paragraph 22 of the Mortgage; and (2) for failing to timely notify the Town Tax Collector within 30 days of the sale of conveying title in accordance with M.G.L. 244 Sec. 15A.
