OHIO UPDATE
On March 27, 2020, in response to the Pandemic, the Ohio Supreme Court put on an Order which tolled the time within which parties in civil matters, including foreclosure actions, would have to answer or otherwise respond to pleading or previously set deadlines. Effectively, what this did was to allow new cases to continue to be filed, but not moved forward beyond that. The order did not, however, have an effect on cases post-judgment.
KENTUCKY UPDATE
The Kentucky Supreme Court Order that stayed all Foreclosure matters was lifted as of June 1, 2020. Cases can be filed and hearings will be held as normal. The only difference is that most of the hearings are now being done either through Zoom or Skype. The hearings that are being held in person are being spaced out time wise to facilitate social distancing and facial coverings are required to enter most court buildings.
WEST VIRGINIA UPDATE
As of non-judicial State, the foreclosure process has been minimally impacted by the Pandemic. There was a Statewide ban on all eviction proceedings pursuant to an order issued by the West Virginia Supreme Court of Appeals, which stayed all non-emergency Judicial proceedings, but this expired as of 5.18.2020. With the exception of the current moratoriums in place with FHA, USDA, VA, Fannie and Freddie, foreclosures can take place in West Virginia. |
