Bendett & McHugh Update in Massachusetts

House Bill 4935 was introduced and would if passed, prohibit exercise of the statutory power of sale, right of entry or initiation of a summary process eviction action between the dates of March 10, 2020 until such time as the Governor rescinded the emergency declaration currently in place in Massachusetts.  

House Bill 4935 was introduced and would if passed, prohibit exercise of the statutory power of sale, right of entry or initiation of a summary process eviction action between the dates of March 10, 2020 until such time as the Governor rescinded the emergency declaration currently in place in Massachusetts.  
 
This bill has not yet been passed however, we are monitoring its progress carefully. We have also discussed with title insurers what the impact of this legislation would be on sales in Massachusetts. We have been advised by at least one insurer that it would decline to insure any foreclosure sale which occurred between March 10, 2020 and the date the emergency declaration is eventually lifted.
