ALFN Member Firms File Federal Class Action Challenging New York’s FAPA

Two ALFN member firms have filed a federal class action lawsuit alleging New York's Foreclosure Abuse Prevention Act unconstitutionally stripped more than $1 billion in mortgage rights.

ALFN member law firms Stern & Eisenberg, in conjunction with Hladik, Onorato & Federman, have initiated a class action lawsuit against the State of New York. The suit, filed in Federal District Court, primarily alleges that New York's Foreclosure Abuse Prevention Act "FAPA" has resulted in the taking of mortgage lenders and servicers rights without just compensation. It is estimated that more than $1 Billion worth of mortgage rights were unconstitutionally stripped as a result of FAPA.
