We were pleased to bring you all of the educational content that we had planned for our in-person Bankruptcy Intersect program, which was offered in an online webinar format between March 16-April 9, 2021.  These presentations were provided at no cost to ALFN members and mortgage servicers.  CLE credit was available only for attendees of the live presentations at a special discount of $100 per state for all 7 webinar presentations (that is 7 hours of potential CLE credit for $100 per state).

This panel will discuss recent legislative updates and their impact on Bankruptcy from the default servicing perspective.  Topics will include the CARES Act, Consolidated Appropriations Act (CAA), Bankruptcy Administration Improvement Act of 2020, Stimulus Bill, and the proposed Consumer Bankruptcy Relief Act.  Panelists will also discuss Bankruptcy statistics and historical data that shed some light on the future of filings as well as discuss challenges and opportunities as we move forward into 2021 and beyond.

Chapter 11 Plans and Confirmation; What Should a Creditor Know?

Chapter 11 is a creature that most mortgage servicers do not encounter, but when one is filed its important to know how to handle. Compiling a Chapter 11 plan and disclosure statement goes well beyond the normal Chapter 13 plan that a creditor is used to reviewing. This session will discuss the drafting of a Chapter 11 plan and disclosure statement from a highly regarded Chapter 11 debtor’s attorney. This panel will also review what should a creditor be looking for in a Chapter 11 plan and disclosure statement, what are the potential pitfalls, what are the potential defenses. This session will also discuss how a Chapter 11 plan and disclosure statement goes from filing to confirmation, specifically addressing objections by creditors and resolving in order to confirm a plan. This is a session that mortgage servicer or its attorney should not miss.

Case Law Updates (Including Fulton US Supreme Court Case)

This seminar will discuss some of the recent significant cases in bankruptcy.  How might the Supreme Court’s decision in City of Chicago v Fulton impact the automatic stay with respect to residential mortgages.  There is also increasing pressure coming in Congress to afford relief to student loan borrowers.  Will a bankruptcy filing be required to obtain forgiveness of student loan debt, and if so, how does this affect other categories of debt, including mortgages.  The panel will also discuss case law surrounding the CARES Act and the Consolidated Appropriations Act.  And with many borrowers receiving mortgage forbearances over the last twelve months, consideration must be given to how the borrower repays the forbearance arrears.  If the loan is modified, how is lien priority affected?

A request for financial hardship assistance must be filed at least 30 days prior to the Attorney attendee registering for the program. To apply, please submit a request via email to Susan Rosen at
